The Tamil Nadu State Minorities Commission Act, 2010

Act 21 of 2010

An Act to constitute a State Commission for Minorities
and to provide for matters connected therewith or incidental thereto.

BE it enacted by the Legislative Assembly of the State of Tamil Nadu in the Sixty-first Year of the Republic of India as follows:—

CHAPTER-I

PRELIMINARY

Section 1

Short title, extent and commencement.

1) This Act may be called the Tamil Nadu State Minorities Commission Act, 2010.

2) It extends to the whole of the State of Tamil Nadu.

3) It shall come into force on such date as the State Government may, by notification, appoint.

Section 2

Definitions

In this Act, unless the context otherwise requires,—

(a) “Commission” means the Tamil Nadu State Minorities Commission constituted under section 3;

(b) “Government” means the State Government;

(c) “member” means a member of the Commission and includes the Chairperson and the Member-Secretary;

(d) “minorities” mean the persons belonging to minority communities residing in the State of Tamil Nadu whom the Government have recognized as minorities;

(e) “prescribed” means prescribed by rules.

CHAPTER-II.

TAMIL NADU STATE MINORITIES COMMISSION.

Section 3

Constitution of the Commission.

1)
The Government shall, by notification, constitute a body to be known as the Tamil Nadu State Minorities Commission to exercise the powers conferred on, and to perform the functions assigned to, it under this Act.

2) The Commission shall consist of,—

(a) a Chairperson and six other members to be nominated by the Government, from amongst persons of eminence, ability and integrity:

Provided that the members including the Chairperson shall be from amongst the minority communities; and

(b) the Commissioner of Minorities Welfare – Member-Secretary.

(3) The head quarters of the Commission shall be at Chennai and the Government may establish one or more offices of the Commission at any other place in the State.

Section 5.

Procedure to be regulated by the Commission.

1) The Commission shall meet as and when necessary atleast once in a month and shall meet at such time and place as the Chairperson may think fit.

2) The Commission shall regulate its own procedure.

3) All orders and decisions of the Commission shall be authenticated by the Member-Secretary or any other Officer of the Commission duly authorised by the Member-Secretary in this behalf.

CHAPTER-III.

FUNCTIONS OF THE COMMISSION.

Section 8.

Functions of the Commission.

1) Subject to the performance of the functions of the National Commission for Minorities under section 9 of the National Commission for Minorities Act, 1992, the functions of the Commission shall be as follows:—

(a) to examine the working of various safeguards provided in the Constitution and in the laws made by the State Legislature for the protection of minorities;

(b) to make recommendations with a view to ensuring effective implementation and enforcement of all the safeguards;

(c) to monitor the working of the safeguards provided in the Constitution, laws enacted by the State Legislature and policies and schemes of the Government for minorities;

(d) to conduct studies, research and analysis on the questions of avoidance of discriminations against minorities;

(e) to make a factual assessment of the representation on minorities in the services of the Government undertakings, Government and quasi-Government bodies and in case the representation is inadequate, to suggest ways and means to achieve the desired level;

(f) to make recommendations for ensuring, maintaining and promoting communal harmony in the State;

(g) to make periodical reports at prescribed intervals to the Government;

(h) to study any other matter which in the opinion of the Commission is important from the point of view of the welfare and development of minorities and to make appropriate
recommendation;

(i) to consider the grievances of the minorities and to suggest appropriate solution, from time to time;

(j) to look into specific complaints regarding deprivation of rights and safeguards of minorities and take up such matter with the appropriate authorities; and

(k) any other matter which may be referred to it by the Government.

2) The Commission shall, while performing any of these functions, have all the powers of a civil court trying a suit under the Code of Civil Procedure, 1908 and in particular,
in respect of the following matters, namely:—

(a) summoning and enforcing the attendance of any person and examining him on oath;

(b) requiring the discovery and production of any document;

(c) receiving evidence on affidavits;

(d) requisitioning any public record or copy thereof from any court or office;

(e) issuing commissions for the examination of witnesses and documents; and

(f) any other matter which may be prescribed.

3) The Government shall cause the recommendations of the Commission to be laid before the Legislative Assembly along with the memorandum explaining the action taken or proposed to be taken on the recommendations and the reasons for non-acceptance, if any, of any of such recommendations.

Section 11.

Annual report.

The Commission shall prepare in such form and at such time, for each financial year, as may be prescribed, its annual report, giving a full account of its activities during the previous financial year and forward a copy thereof to the Government.

Section 12.

Annual report and audit report to be laid before the Legislative Assembly

The Government shall cause the annual report together with a memorandum of action taken on the recommendations contained therein in so far as they relate to the Government and the audit report to be laid as soon as may be after the reports are received, before the Legislative Assembly.

Il est adopté par l'Assemblée législative de l'État du Tamil Nadu, dans la soixante et unième année de la république de l'Inde, ce qui suit:

CHAPITRE I

PRÉLIMINAIRE

Article 1er

Titre abrégé, application et début

1) La présente loi peut être désignée comme la Loi sur la Commission pour les minorités de l'État du Tamil Nadu de 2010.

2) Elle s'applique à l'ensemble de l'État du Tamil Nadu.

3) Elle entre en vigueur à la date que le gouvernement de l'État peut, par un avis, désigner.

Article 2

Définitions

Dans la présente loi, à moins que le contexte ne s'y oppose :

(a) «Commission» désigne la Commission pour les minorités de l'État du Tamil Nadu, constituée en vertu de l'article 3;

(b) «Gouvernement» désigne le gouvernement de l'État;

(c) «membre» désigne un membre de la Commission et comprend le président et le secrétaire -membre;

(D) «minorités» désigne les personnes appartenant à des communautés minoritaires résidant dans l'État du Tamil Nadu et que le gouvernement a reconnu comme minorités;

(E) «prescrit(e)» signifie prescrit par les règlements.

CHAPITRE II

COMMISSION DES MINORITÉS DE L'ÉTAT DU TAMIL NADU

Article 3

Constitution de la Commission

1) Le gouvernement doit, par un avis, créer un organisme qui sera désigné comme la Commission pour les minorités de l'État du Tamil Nadu afin d'exercer les pouvoirs conférés et à remplir les fonctions assignées aux termes de la présente loi.

2) La Commission est composée :

(a) d'un président et de six autres membres nommés par le gouvernement, parmi des personnalités qualifiées pour leur aptitude et leur intégrité:

À la condition que les membres, dont le président, soient choisis parmi les communautés minoritaires; et

(b) du commissaire à la protection des minorités, secrétaire membre.

3) Le siège social de la Commission est à Chennai et le gouvernement peut prévoir un ou plusieurs bureaux de la Commission à tout autre endroit dans l'État.

Article 5

Procédure à être réglementée par la Commission.

1) La Commission se réunit, s'il est nécessaire, au moins une fois par mois et doit se réunir au moment et au lieu que le président estime approprié.

2) La Commission adopte sa propre procédure.

3) Toutes les ordonnances et les décisions de la Commission doivent être authentifiées par le secrétaire membre ou par tout autre agent de la Commission que le secrétaire a dûment autorisés à ce sujet.

CHAPITRE III

FONCTIONS DE LA COMMISSION

Article 8

Fonctions de la Commission

1) Sous réserve de l'exercice des fonctions de la Commission nationale pour les minorités, conformément à l'article 9 de la Loi sur la Commission nationale pour els minorités de 1992, les fonctions de la Commission sont les suivantes:

(a) examiner le fonctionnement des diverses mesures de protection prévues dans la Constitution et dans les lois adoptées par la législature de l'État concernant la protection des minorités;

(b) faire des recommandations en vue d'assurer la mise en œuvre effective et l'application de toutes les mesures de protection;

(c) surveiller le fonctionnement des mesures de protection prévues dans la Constitution, dans les lois promulguées par la législature de l'État ainsi que dans les politiques et les programmes du gouvernement concernant les minorités;

(d) réaliser des études, des recherches et des analyses sur les questions de prévention de la discrimination contre les minorités;

(e) faire une évaluation factuelle de la représentation des minorités dans les services des entreprises publiques, des organismes gouvernementaux et quasi-gouvernementaux et, dans cas où cette représentation serait insuffisante, proposer des voies et des moyens pour atteindre le niveau désiré ;

(f) faire des recommandations visant à assurer, à maintenir et à promouvoir l'harmonie entre les communautés dans l'État;

(g) présenter des rapports périodiques à des intervalles prescrits par le gouvernement;

(h) étudier toute autre question qui, de l'avis de la Commission, est importante du point de vue de la protection sociale et du développement des minorités, et de faire des recommandations appropriées;

(i) examiner les griefs des minorités et proposer périodiquement des solutions appropriées;

(j) examiner les plaintes spécifiques concernant la suppression des droits et des mesures de protection des minorités et reprendre cette question auprès des autorités compétentes; et

(k) toute autre question qui peut être saisie par le gouvernement.

2) La Commission, tout en effectuant une de ces fonctions, détient tous les pouvoirs d'un tribunal civil en intentant des poursuites judiciaires en vertu du Code de procédure civile de 1908 et, en particulier, en ce qui concerne les questions suivantes, à savoir:

(a) assigner et faire comparaître une personne, et l'interroger sous serment;

(b) exiger la découverte et la production de documents;

(c) recevoir des témoignages sur les déclarations assermentées;

(d) demander des documents publics ou des copies auprès d'un tribunal ou d'un bureau;

(e) émettre des mandats pour l'examen des témoins et des documents; et

(f) toute autre question qui peut être prescrite.

3) Le Gouvernement veillera à ce que les recommandations de la Commission soient déposées devant l'Assemblée législative ainsi que les notes de service expliquant les mesures prises ou proposées sur les recommandations et les raisons d'un refus, le cas échéant, de l'une de ces recommandations.

Article 11

Rapport annuel

La Commission doit préparer pour chaque exercice financier, selon les formes et le moment prescrits, son rapport annuel en donnant un compte rendu complet de ses activités au cours de l'exercice précédent et en transmettant un exemplaire de celui-ci au gouvernement.

Article 12

Rapport annuel et rapport de vérification à déposer devant l'Assemblée législative

Le gouvernement doit présenter son rapport annuel ainsi qu'un exposé des mesures prises à partir des recommandations qui y sont contenues en autant qu'elles se rapportent au gouvernement et au rapport de vérification aussitôt que possible après les rapports soient reçus à l'Assemblée législative.
