Article 32.

Working language of courts

1) The language of judicial proceedings and court procedure is Estonian.

2) Minutes of court sessions and other procedural acts are prepared in Estonian. A court may also record any testimony or statement given in a court session in a foreign language in the minutes in the language in which it is given in addition to the translation thereof into Estonian if it is necessary for an accurate presentation of the testimony or statement.

3) The Republic of Estonia accepts translations of forms into English on the basis of Article 57(2) of Regulation (EU) No 1215/2012 of the European Parliament and of the Council on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (OJ L 351, 20.12.2012, p. 1–32).

Article 33.

Documents in foreign language in judicial proceedings

1) If a petition, request, appeal or objection submitted to the court by a participant in a proceeding is not in Estonian, the court requires that the person submitting such documents provide a translation thereof into Estonian by the set due date. If a documentary evidence submitted to the court by a participant in a proceeding is not in Estonian, the court requires that the person submitting such documents provide a translation thereof into Estonian by the set due date unless translation of the evidence is unreasonable considering its contents or volume and other participants in the proceeding do not object to accepting the evidence in another language.

Article 34.

Participation of interpreter or translator in proceedings

1) If a participant in a proceeding is not proficient in Estonian and he or she does not have a representative in the proceeding, the court involves, if possible, an interpreter or translator in the proceeding at the request of such participant in the proceeding or at the initiative of the court. An interpreter or translator need not be involved if the statements of the participant in the proceeding can be understood by the court and the other participants in the proceeding.

Article 35.

Involvement of interpreter or translator in case of deaf, mute or deaf-mute participant in proceeding

If a participant in a proceeding is a deaf, mute or deaf-mute person, the course of the proceeding is communicated to him or her in writing, or an interpreter or translator is involved in the proceeding.

Article 36.

Oath and signature of person not proficient in Estonian

1) A person who is not proficient in Estonian gives an oath or signature on being cautioned of his or her liability in a language in which he or she is proficient.

2) A signature is given on the text of the oath or caution prepared in Estonian which is translated to the person directly before he or she signs it.

Article 441.

Preparation of judgment

1) The court prepares a judgment electronically in the Estonian language and signs it with the digital signature of the judge who has made the judgment. The court registers the judgment promptly in the information system of the courts.

Article 464.

Making of ruling

1) A ruling may be made without holding a court session and without hearing the participants in the proceeding unless otherwise prescribed by law.

2) The court may make oral and written rulings in a court session. Oral rulings are pronounced promptly and recorded in the minutes. If a court ruling is subject to appeal pursuant to law, the ruling shall be made in writing in the Estonian language and shall be signed.

Article 734.

Language of proceeding

1) The parties may agree on the language of arbitration proceeding. If there is no agreement, the language of the proceeding is determined by the arbitral tribunal.

2) Unless otherwise prescribed by the agreement of the parties or a ruling of an arbitral tribunal, the petitions of the parties, the decision of the arbitral tribunal and other notices of the arbitral tribunal shall be prepared and the sessions of the arbitral tribunal shall be held in the language agreed upon or prescribed.

3) An arbitral tribunal may demand the submission of written certificates together with a translation thereof into the language agreed upon between the parties or prescribed by the arbitral tribunal.

Article 32

Langue de travail des tribunaux

1) La langue de la procédure judiciaire et de la cour est l'estonien.

2) Les procès-verbaux et les autres actes de procédure doivent être rédigés en estonien. Un tribunal peut également enregistrer une déposition ou une déclaration transmise dans une audience de la cour dans une langue étrangère au procès-verbal dans la langue dans laquelle elle a été prononcée en plus de la traduction en estonien si cela est nécessaire pour une présentation exacte de la déposition ou de la déclaration.

3) La république d'Estonie accepte la traduction de formulaires en anglais sur la base de l'article 57, paragraphe 2, du règlement (UE) n° 1215/2012 du Parlement européen et du Conseil concernant la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et en matière commerciale (Journal officiel n° 351 du 20.12.2012, p. 1-32).

Article 33

Documents en langue étrangère dans une procédure judiciaire

1) Si une pétition, une requête, une objection ou un appel présenté au tribunal par un participant à une procédure n'est pas fait en estonien, le tribunal exige que la personne qui présente ces documents fournisse une traduction en estonien à la date fixée. Si une preuve documentaire présentée au tribunal par un participant à une procédure n'est pas en estonien, le tribunal exige que la personne qui présente ces documents fournisse une traduction en estonien à la date fixée, à moins que la traduction de la preuve ne soit déraisonnable, compte tenu de son contenu ou de sa taille et des autres participants à la procédure qui ne s'opposeraient pas à accepter la preuve dans une autre langue.

Article 34

Participation d'un interprète ou d'un traducteur dans une procédure

1) Si un participant à une procédure ne maîtrise pas l'estonien et qu'il n'a pas de représentant à la procédure, le tribunal recourt, si possible, à un interprète ou à un traducteur dans la procédure à la demande de ce participant ou à l'initiative du tribunal. Un interprète ou un traducteur ne doit pas être demandé si les déclarations du participant à la procédure peuvent être comprises par le tribunal et par les autres participants à l'instance.

Article 35

Participation d'un interprète ou d'un traducteur pour un participant sourd, muet ou sourd-muet à la procédure

Si un participant à une instance est sourd, muet ou sourd-muet, le déroulement de la procédure lui est communiqué par écrit, ou le recours à un interprète ou à un traducteur est demandé pour la procédure.

Article 36

Serment et signature d'un justiciable ne maîtrisant pas l'estonien

1) Quiconque ne maîtrise pas l'estonien prête serment ou appose sa signature en étant averti de sa responsabilité dans une langue qu'il maîtrise.

2) La signature est apposée sur le texte du serment ou du témoignage préparé en estonien et traduit à la personne directement avant qu'elle le signe.

Article 441

Préparation de la sentence

1) Le tribunal prépare la sentence par voie électronique en estonien et la signe avec la signature numérique du juge qui a rendu le jugement. Le tribunal enregistre rapidement la sentence dans le système d'information des tribunaux.

Article 464

Prise de décision

1) Une décision peut être rendue sans tenir de séance judiciaire et sans entendre les participants à la procédure, sauf disposition contraire de la loi.

2) La cour peut rendre des décisions orales et écrites en audience devant le tribunal. Les décisions orales sont prononcées rapidement et consignées dans le procès-verbal. Si une décision judiciaire est susceptible d'appel en vertu de la loi, la décision est rendue par écrit en estonien et doit être signée.

Article 734

Langue de la procédure

1) Les parties peuvent convenir de la langue de la procédure d'arbitrage. En l'absence d'accord, la langue de l'instance est décidée par le tribunal arbitral.

2) Sauf par une disposition contraire des parties ou d'une décision d'un tribunal arbitral, les pétitions des parties, la décision du tribunal arbitral et les autres avis du tribunal arbitral doivent être présentés dans la langue convenue ou prescrite, ainsi que les sessions du tribunal arbitral.

3) Un tribunal arbitral peut exiger la remise de certificats écrits accompagnés d'une traduction dans la langue convenue entre les parties ou prescrite par le tribunal arbitral.
