Welsh Language Act 1993
(1993 Chapter c. 38)
An Act to establish a Board having the function of promoting and
facilitating the use of the Welsh language, to provide for the preparation
by public bodies of schemes giving effect to the principle that in the
conduct of public business and the administration of justice in Wales the
English and Welsh languages should be treated on a basis of equality, to
make further provision relating to the Welsh language, to repeal certain
spent enactments relating to Wales, and for connected purposes. [21st
October 1993]
Be it enacted by the Queen's most Excellent Majesty, by and with the
advice and consent of the Lords Spiritual and Temporal, and Commons, in
this present Parliament assembled, and by the authority of the same, as
follows:
Part I
THE BOARD
Section
1
Establishment of the Board
There shall be a body corporate to be known as Bwrdd yr Iaith Gymraeg
or the Welsh Language Board.
Section 2
Membership of the Board
(1) The Board established under section 1 above (referred to in this
Act as "the Board") shall consist of not more than fifteen members
appointed by the Secretary of State.
(2) In exercising his power of appointment under subsection (1) above the
Secretary of State shall have regard to the desirability of securing that,
within the Board's membership, there are reflected both the varying extent
to which the Welsh language is used by those living in Wales, and the
range of interests of the persons to whom the Board will offer advice.
Section 3
Functions of the Board
(1) The Board shall have the function of promoting and facilitating the
use of the Welsh language.
(2) Without prejudice to the generality of subsection (1) above, the Board
shall in carrying out the function mentioned there—
a) advise the Secretary of State on matters concerning the Welsh language;
b) advise persons exercising functions of a public nature on the ways in
which effect may be given to the principle that, in the conduct of public
business and the administration of justice in Wales, the English and Welsh
languages should be treated on a basis of equality;
c) advise those and other persons providing services to the public on the
use of the Welsh language in their dealings with the public in Wales.
(3) Subject to the following provisions, the Board may do anything which
is incidental or conducive to the performance of its functions, and may in
particular—
a) make grants and loans and give guarantees;
b) make charges for the provision of advice or other services;
c) accept gifts of money or other property.
(4) The Board shall not—
a) make a grant or loan,
b) give a guarantee, or
c) acquire or dispose of any interest in land,
except with the approval of the Secretary of State given with the consent
of the Treasury.
Section 4
Supplementary provisions about the Board
(1) The Board shall comply with any general or special directions given
to it by the Secretary of State, and shall give him such information about
the exercise of its functions as he may require.
(2) Schedule 1 to this Act shall have effect with respect to the Board. |

pour prévoir la préparation par l'administration publique de programmes
donnant effet au principe que, dans la conduite des affaires publiques et
de l'administration de la justice au pays de Galles, les langues anglaise et
galloise doivent être traitées sur un pied d'égalité, pour prendre de
meilleures dispositions relatives à la langue galloise, pour abroger certaines
promulgations désuètes concernant le pays de Galles et pour les fins

Sa Majesté la Reine, sur avis et
avec le consentement des membres ecclésiastiques et laïcs de la Chambre
des lords et des Communes, en présence du Parlement rassemblé et en vertu
de l'autorité qui lui est conférée, décrète ce qui suit:

LE CONSEIL
Article 1
Établissement du Conseil
Il est créé une personne morale connue
sous le nom de Bwrdd yr Iaith
Gymraeg ou Conseil de la langue galloise.
Article
2
Effectifs
du Conseil
(1) Le Conseil créé
par l'article 1 précédent (mentionné dans la présente loi comme «le Conseil»)
est composé d'un maximum de quinze membres nommés
par le secrétaire d'État.
(2) Dans l'exercice de son pouvoir de nomination en vertu du paragraphe 1,
le secrétaire d'État doit considérer les avantages assurant que, dans les effectifs du Conseil,
il y est reflété à la fois l'étendue variable dans laquelle le gallois est
employé par ceux qui résident au pays de Galles ainsi que la gamme des intérêts
personnels à qui le Conseil offre ses services.
Article 3
Les fonctions du Conseil
(1) Le Conseil a comme fonction de promouvoir et de faciliter l'usage
de la langue galloise.
(2) Sans préjudice du caractère général du paragraphe 1 ci-dessus,
le Conseil doit exercer les fonctions suivantes mentionnées:
a) conseiller le secrétaire d'État
sur les questions concernant la
langue galloise;
b) conseiller les personnes exerçant les fonctions de nature
publique au moyen desquelles il est possible d'appliquer le principe
que, dans la conduite des affaires publiques et de l'administration de la justice au
pays de Galles, les langues anglaise et galloise doivent être traitées
sur un pied d'égalité;
c) conseiller d'autres personnes dispensant des
services au public sur l'usage de la langue galloise dans leurs
transactions avec le public du pays de Galles.
(3) Sous réserve des dispositions suivantes, le Conseil peut faire tout qui est
favorable ou utile à l'exercice de ses fonctions, et
en particulier:
a) accorder des subventions et des prêts, et
offrir des garanties;
b) exiger des frais pour offrir des conseils ou d'autres services;
c) accepter des dons en argent ou d'autres biens.
(4) Le Conseil ne pourra:
a) accorder de subventions ni
de prêts,
b) offrir des garanties, ou
c) acquérir ou disposer d'un quelconque intérêt dans une propriété,
sauf avec l'approbation du secrétaire d'État
accordée avec le consentement du
Trésor public.
Article 4
Dispositions supplémentaires du Conseil
(1) Le Conseil se
conforme à toute directive générale ou
particulière transmise par le secrétaire d'État et lui fait part de toute
information dans l'exercice de ses fonctions, comme il peut lui être
demandé.
(2) L'annexe 1 de la présente loi prend effet en tenant compte du
Conseil. |
