Article 11

9) Unless particular reasons make it inappropriate, it is a
condition for the issuing of a permanent residence permit that the alien:
- (i) has completed an introduction programme offered to him
pursuant to the Integration Act or, if this is not the case, has
completed another comparable course, cf. subsection (11);
- (ii) has passed a test in the Danish language approved by the
Minister for Refugee, Immigration and Integration Affairs, cf.
subsection (11); and
- (iii) has no overdue debt to public authorities, cf. subsection
(11.
11)
The Minister for Refugee, Immigration and Integration
Affairs lays down more detailed rules on the application of subsections
(3) to (6) and (9) and on the opinion of the local council according to
section 52 of the Integration Act.
Article 42 f
1) An alien over the age of 18 who is lodged in a reception centre
for newly arrived aliens having submitted an application for a residence
permit pursuant to section 7, cf. section 42 a(5), and who has submitted
an application for a residence permit pursuant to section 7 shall,
unless particular reasons make it inappropriate, attend tuition intended
to give the alien a very introductory knowledge of the Danish language
and the Danish culture and society (introduction course).
2) An alien over the age of 18 who
falls within section 42 a(1) or (2), cf. subsection (3), and who is
registered as an asylum-seeker under section 48 e(1) or who has stayed
in Denmark for more than 3 months from the date of his submission of an
application for a residence permit pursuant to section 7 shall, unless
particular reasons make it inappropriate, attend tuition in the Danish
or English language and the Danish culture and society , but cf.
subsection (6).
5) A 17-year-old alien who falls within section 42 a(1) and (2),
cf. subsection (3), may attend an introduction course, cf. subsection
(1), tuition in the Danish language and the Danish culture and society,
cf. subsection (2), and tuition in other subjects, cf. subsection (3),
but cf. subsection (6). 17-year-old aliens may attend the introduction
course and the tuition mentioned in subsections (2) and (3) on the same
conditions as aliens over the age of 18, cf. subsections (1) to (3).
Subsection (4) applies correspondingly. |

9) À moins que des raisons particulières ne paraissent
inappropriées, il est obligatoire à un étranger pour obtenir un permis de
séjour permanent :
-(i) qu'il ait terminé un programme élémentaire offert conformément
à la Loi sur l'intégration ou, si ce n'est guère le cas, ait terminé un
autre cours comparable, conformément au paragraphe 11;
- (ii) qu'il ait passé un test en danois approuvé par le ministre des
Réfugiés, de l'Immigration et des Affaires d'intégration, conformément
au paragraphe 11; et
- (iii) qu'il n'ait aucune dette échue auprès des autorités publiques,
conformément au paragraphe 11.
11) Le ministre des Réfugiés, de l'Immigration et des Affaires
d'intégration fixe des règles plus détaillées sur l'application des
alinéas (3) à (6) et (9) et sur l'avis du conseil local en vertu de
l'article 52 de la Loi sur l'intégration.
Article 42 f
1) Un étranger âgé de plus de 18 ans. qui est logé dans un centre
d'accueil pour étrangers nouvellement arrivés et qui a soumis une demande
pour obtenir un permis de séjour, en vertu de l'article 7, conformément
à l'article 42 (5), et qui a soumis une demande pour un permis de séjour
conformément à l'article 7, à moins que des raisons particulières
paraissent inappropriées, doit assister au cours prévu qui lui
permettra de recevoir une connaissance préliminaire du danois et de
la culture et de la danoises (cours d'introduction).
2) Un étranger âgé de plus de 18 ans, qui est assujetti à
l'article 42.1 ou 42.2, conformément à l'alinéa 3, et qui est enregistré
comme demandeur d'asile en vertu de l'article 48 e (1) ou qui est resté
au Danemark pour plus de trois mois à partir de la date de sa demande de
permis de séjour conformément à l'article 7, et à moins que des raisons
particulières ne paraissent inappropriées, doit suivre un cours en
danois ou en anglais, ainsi que sur la culture et la société danoises, le
tout en
conformité avec le paragraphe 6.
5) Un étranger âgé de 17 ans, qui est assujetti à l'article 42.1 et
42.2, conformément au paragraphe 3, peut suivre un cours d'introduction,
en vertu du paragraphe 1, un enseignement en danois et sur la culture
et la société danoises, conformément au paragraphe 2, et des cours sur
d'autres matières, conformément aux paragraphes 3 et 6. Les étrangers
âgés de 17 ans peuvent suivre le cours d'introduction et les cours
mentionnés aux paragraphes 2 et 3, selon les mêmes conditions que les
cours destinés aux étrangers âgés de 18 ans, conformément aux paragraphes
1 à 3. Le paragraphe 4 s'applique également. |
