Hongrie: Décret VVV-30 sur l'Office des minorités nationales et ethniques

Government Decree No 125/2001. (VII. 10.)
on the Office for National and Ethnic Minorities

Section 1

The Government, in compliance with the stipulations of Act LXXVII/1993 Section 62, subsection (1) on the rights of the national and ethnic minorities, shall establish an Office for National and Ethnic Minorities (hereafter: the Office) to meet the government�s responsibilities related to the national and ethnic minorities in Hungary.

Section 2

1) The Office will be an autonomous agency of public administration with nation-wide authority, working under the supervision of the Minister of Justice.

2) The President of the Office will be appointed by the Prime Minister upon the proposition of the Minister of Justice.

3) Two Vice-Presidents of the Office will be appointed by the Minister of Justice upon the proposition of the President.

4) The Statutes of the Office shall be established by the President and approved by the Minister of Justice.

Section 3

The Office will be a budgetary institution having full rights and an independent management; its budget will be an independent title within the chapter of the Ministry of Justice.

Section 4

Relating to the Government's minority policy, the Office shall

a) prepare government decisions on minority policy
b) co-ordinate the execution of the government programme with regard to the minorities;
c) contribute to the review of the Act No LXXVII/1993 on the rights of national and ethnic minorities (hereafter Minorities Act) and the related legal regulations and the preparation of amendments;
d) continuously analyse and assess the enforcement of national and ethnic minority rights, analyse and assess the position of the minorities, in order to facilitate the adoption of governmental decisions;
e) prepare a bi-annual government report as stipulated in Section 63, subsection (3) of the Minorities Act;
f) promote the exchange of views and information between the Government and minority organisations.

Section 5

With regard to the responsibilities of public administration agencies related to the minorities, the Office shall

a) monitor the implementation of minority tasks that belong to the scope of other public administration bodies;
b) initiate measures if necessary;
c) participate in opinion forming on issues affecting the minorities and assist in the co-ordination of minority opinions;

Section 6

With regard to minority organisations, the Office shall

a) liaise with minority self-governments, the interest representing groups of the minorities and other professional organisations and provide professional assistance if so required;
b) contribute, within the framework of agreements with minority organisations, to revealing minority interests and to an assessment of particular minority needs.

Section 7

The Office shall liaise with the Parliamentary Committee dealing with minority issues and with the Ombudsman of national and ethnic minority rights.

Section 8

The office shall:

a) in the spirit of the principles of international treaties, build relations with the kin-States or linguistic kin-nations of the minorities in the interest of the national minorities living in Hungary;
b) liaise with international organisations and institutions that deal with the protection of the rights of minorities living in different countries.

Section 9

In terms of informing the public about the position of the minorities, the Office shall

a) monitor the trends of public opinion on minorities including the domestic and international press;
b) regularly inform the public on the implementation of the objectives of minority policy;
c) operate an information service to promote better information of the minority population, public administration bodies and the media;
d) keep records of the needs and tasks related to the minorities and on the position of the minorities; build and maintain contacts with research institutions and workshops.

Section 10

The Office shall

a) function as the secretariat of the Inter-Ministerial Committee on Roma Issues;
b) meet the responsibilities set for the Office by the Government in the joint committees and inter-ministerial committees established by the Government.

Section 11 With regard to State and budgetary subsidies for the minorities, the Office shall

a) prepare government-level financing programmes related to minority tasks;
b) prepare the evaluation of minority co-ordination and intervention applications and control their execution;
c) meet its responsibilities in terms of general support provided to the local minority self-governments for their operation as stipulated in the Budget Act.

Section 12

The Office shall contribute to the fulfillment of the tasks regarding the operation of the Hungarian Public Foundation for National and Ethnic Minorities and the Public Foundation for the Roma in Hungary.

Section 13

The President of the Office shall function as the Chairman of the Board of Trustees of the Hungarian Public Foundation for National and Ethnic Minorities and as Deputy Chairman of the Inter-Ministerial Committee on Roma issues.

Section 14

The Office shall meet the responsibilities within its scope of authority as stipulated in legal regulations or other legal means of state administration.

Section 15

This Decree shall take effect on day 15 after it has been published; at the same time the Government Decree No 34/1990 (VIII. 30) on the Office of the National and Ethnic Minorities as well as the Government Decree No 128/1998 (VII.15), Section 4 on the amendment of certain government decrees related to the establishment of the government shall expire.

sur l'Office des minorités nationales et ethniques

Article 1^er

Le gouvernement, en conformité avec les dispositions de l'article 62 de la loi LXXVII/1993, au paragraphe 1, relative aux droits des minorités nationales et ethniques, établit un Office des minorités nationales et ethniques (ci-après : l'Office) pour répondre aux responsabilités du gouvernement à l'égard des minorités nationales et ethniques en Hongrie.

Article 2

1) L'Office est un organisme autonome d'administration publique compétente au niveau national, placé sous la tutelle du ministre de la Justice.

2) Le directeur de l'Office est nommée par le premier ministre sur recommandation du ministre de la Justice.

3) Les deux directeurs adjoints de l'Office sont nommés par le ministre de la Justice sur recommandation du directeur.

4) Les statuts de l'Office sont proposés par le directeur et approuvés par le ministre de la Justice.

Article 3

L'Office est une institution budgétaire de plein droit et dotée d'une gestion indépendante; son budget demeure un acte indépendant dans le chapitre du ministère de la Justice.

Article 4

Au sujet de la politique gouvernementale sur les minorités, l'Office doit:

a) préparer les décisions gouvernementales sur la politique des minorités;
b) coordonner le programme d'action gouvernemental à l'intention des minorités;
c) contribuer à la révision de la loi LXXVII/1993 sur les droits des minorités nationales et ethniques (ci-après Loi sur les minorités) et des règlements apparentés ainsi que la préparation des modifications;
d) évaluer en permanence la mise en oeuvre des droits des minorités nationales et ethniques, ainsi que la situation des minorités, afin de faciliter l'adoption des mesures gouvernementales;
e) préparer un rapport gouvernemental bisannuel, tel qu'il est prévu au paragraphe 3 de l'article 63 de la Loi sur les minorités;
f) promouvoir l'échange d'opinions et d'informations entre les organisations minoritaires et le gouvernement.

Article 5

En ce qui concerne les responsabilités des organismes d'administration publique à l'égard des minorités, l'Office doit:

a) contrôler la mise en oeuvre des missions des minorités relevant de la compétence des autres entités de l'administration publique;
b) amorcer les mesures nécessaires;
c) participer à l'évaluation et aider à la coordination des résolutions concernant les questions relatives aux minorités;

Article 6

En ce qui concerne les organisations minoritaires, l'Office doit:

a) agir en concertation avec les instances des autonomies pour les minorités, les groupes de représentation d'intérêt pour les minorités et d'autres organismes professionnels et leur fournir une assistance professionnelle si c'est nécessaire;
b) contribuer, dans la structure des accords avec les organismes minoritaires, à faire connaître les intérêts des minorités et à évaluer leurs besoins particuliers.

Article 7

L'Office agit en concertation avec le comité parlementaire traitant des questions des minorités et le médiateur des droits des minorités nationales et ethniques.

Article 8

L'Office doit:

a) dans l'esprit des principes consacrés par les traités internationaux, entretenir des relations avec les États ou les nations d'origine linguistique des minorités dans l'intérêt desdites minorités nationales vivant en Hongrie;
b) agir en concertation avec les organisations internationales et les établissements qui traitent de la protection des droits des minorités vivant dans des pays différents.

Article 9

Afin d'informer le public sur la situation des minorités, l'Office doit:

a) surveiller les tendances de l'opinion publique sur les minorités, incluant la presse nationale et internationale;
b) informer régulièrement le public sur la mise en oeuvre des objectifs de la politique sur les minorités;
c) faire fonctionner un service d'information afin de promouvoir la meilleure information auprès des populations minoritaires, des entités d'administration publiques et des médias;
d) tenir des dossiers sur les besoins et les missions reliées minorités et sur la situation de ces minorités; tisser et entretenir des contacts avec les établissements et des ateliers de recherche.

Article 10

L'Office doit:

a) accomplir ses fonctions à l'exemple du secrétariat au comité inter-ministériel sur les questions tsiganes;
b) répondre de ses responsabilités établies pour l'Office par le gouvernement à l'égard des comités ordinaires et des comités inter-ministériels prévus par le gouvernement.

Article 11

En ce qui concerne les subventions de l'État et les budgets destinés aux minorités, l'Office doit:

a) préparer le plan gouvernemental finançant les programmes liés aux missions des minorités;
b) préparer l'évaluation de la coordination des minorités et des demandes d'intervention et veiller à leur mise en oeuvre;
c) répondre de ses responsabilités en termes d'appui général accordé aux autonomies des minorités locales pour leur opération, tel qu'Il est prévu dans la Loi sur le budget.

Article 12

L'Office contribue à l'exercice du mandat concernant le fonctionnement de la Fondation publique hongroise pour les minorités nationales et ethniques et la Fondation publique pour les Tsiganes de Hongrie.

Article 13

Le directeur de l'Office exerce les fonctions de président du conseil d'administration de la Fondation publique hongroise pour les minorités nationales et ethniques et de vice-président du comité inter-ministériel sur les questions tsiganes.

Article 14

L'Office répond de ses responsabilités dans l'étendue de son autorité, tel qu'il est prévu par règlement ou par d'autres mesures juridiques de l'administration de l'État.

Article 15

Le présent décret entre en vigueur le 15e jour après sa publication; en même temps, le Décret gouvernemental no 34/1990 (VIII 30) sur l'Office des minorités nationales et ethniques, ainsi que le Décret gouvernemental no 128/1998 (VII15), ainsi que l'article 4 sur les modifications de certains décrets gouvernementaux reliés à leur établissement sont abrogés.
