Provision to secure protection of law

a) shall be presumed innocent until proved guilty according to law;

b) shall be informed promptly in a language that he understands and in detail of the nature of the offence with which he is charged;

(c) shall be given adequate time and facilities for the preparation of his defence;

(d) shall be permitted to have without payment the assistance of an interpreter if he cannot understand or speak the language used at the trial of the charge;

Language of the Courts

(1) The language of the Supreme Court shall be English.

(2) The language of the District Court shall be Nauruan or English, as the magistrate having charge of the proceedings in any cause or matter shall direct.

(3) Where at the hearing by the District Court of any cause or matter which is subsequently transferred to the Supreme Court the language used by the District Court is Nauruan, the record made by the magistrate and any affidavits and exhibits in the Nauruan language shall be translated into the English language by the Clerk before the record is transmitted to the Registrar and shall be certified by the Clerk to be a correct translation;

and any party to the cause or matter may, on the payment of the prescribed fee, obtain from the Registrar a copy of that translation.

Langue des tribunaux

(1) La langue de la Cour suprême est l'anglais.

(2) La langue de la cour de district est le nauruan ou l'anglais, tel que le décidera le magistrat ayant la responsabilité de la procédure dans une cause ou une affaire.

(3) Lorsque l'audience dans une cause ou une affaire à une cour de district est plus tard transférée à la Cour suprême, la langue utilisée par le tribunal de district est le nauruan; le compte rendu fait par le magistrat et les affidavits et les documents en nauruan doivent être traduits en anglais par le greffier avant que le dossier ne soit transmis au registraire et ils doivent être certifiés par le greffier pour être reconnus comme une traduction correcte;

et toute partie à la cause ou l'affaire peut, sur paiement de la taxe prescrite, obtenir du registraire une copie de cette traduction.
